Edição e recepção de Kelsen no Brasil

A importância e a influência da obra de Hans Kelsen no Brasil se evidenciam na enorme atenção editorial e bibliográfica que recebe no país. Entretanto, as versões disponíveis ao leitor brasileiro das edições de 1934 e 1960 de seu livro mais famoso, Teoria pura do Direito, jamais receberam traduções brasileiras. Tampouco se criou uma tradição analítica da recepção da obra. Sem análise circunstanciada, restou negligenciado o aproveitamento brasileiro de um de seus traços mais característicos, o generalismo universalista. Essa sugestão está presente num episódio famoso da história política pátria, no qual protagoniza a dimensão generalista da teoria pura: o parecer de Kelsen acerca da competência da Assembleia Constituinte de 1933, cujo contexto de solicitação e consequência ainda não foi esclarecido.

The themes surrounding Kelsen’s thought have received considerable specialized attention in Brazil. Among them, its resource to the critical philosophy tradition may well be the most controversial. There are many reasons to introduce oneself into Kelsen’s works, but a specially neglected one by an otherwise attentive bibliography is the comprehension of the author as a reference for Brazilian Juridical Thought. This is of consequence. The generalistic features of Kelsen’s thought, and its result, the relativism of values and a tolerance to different contents of the different juridical orders has had very curious uses, one of them quite famous and specially contrary to Kelsen’s convictions. The author also does not receive qualitative attention from the editors, whom have never made available a Brazilian translation of the Pure theory of Law, distributing for over 80 years a Portuguese translation that does not even take into account Kelsen’s own notes on the translation of his work.
